Terms of Service

1. Who we are
Wimpur is operated by Wimpur B.V., a private limited company incorporated in the Netherlands, with registered office at [address, to be completed], registered with the Dutch Chamber of Commerce under KvK number [to be completed] and VAT number [to be completed] ("Wimpur", "we", "us"). Wimpur operates a platform that connects people seeking meaning and purpose ("seekers") with verified psychologists ("practitioners"). By using Wimpur you agree to these Terms.
2. The service
Wimpur is an introduction and booking platform. We facilitate matches and payments, but the professional relationship is between the seeker and the practitioner. Wimpur is not a clinical care provider, and the platform is not a substitute for therapy, crisis services, or emergency care.
3. Eligibility
You must be at least 18 years old and able to enter a binding contract. Practitioners must hold a valid license in the jurisdiction where they practice and complete our verification process before publishing a profile.
4. Verification disclaimer
We review each practitioner's credentials before publication, but Wimpur does not warrant the outcome of any session. You are responsible for evaluating fit and reporting concerns.
5. Payments and fees
Sessions are paid through Stripe. Wimpur takes a platform fee of 15% of each session; the remainder is paid to the practitioner via Stripe Connect. Prices shown on practitioner profiles are the full session price.
6. Cancellations and refunds
Sessions can be cancelled by either party before the scheduled start. Refund policy beyond the platform default is set by each practitioner and disclosed before booking.
6a. Right of withdrawal (EU consumers)
If you are a consumer in the European Union, you have the right to withdraw from the contract with Wimpur within 14 days of account creation, without giving any reason, under the EU Consumer Rights Directive (Directive 2011/83/EU). To exercise this right, send a clear statement to hello@wimpur.com before the 14-day period expires.
By booking and paying for a session that is scheduled to take place within the 14-day withdrawal period, you expressly request that the service begins during that period and acknowledge that, once the session has been fully performed, you lose the right of withdrawal for that specific session (Art. 16(a) Directive 2011/83/EU). Sessions that have not yet taken place can still be cancelled in line with section 6 above.
7. Acceptable use
You agree not to misuse the platform, harass other users, share unlawful content, attempt to bypass payments, or scrape data. We may suspend accounts that violate these rules.
8. Limitation of liability
To the maximum extent permitted by law, Wimpur is not liable for indirect, incidental, or consequential damages arising from use of the platform. Our total liability is capped at the fees paid to Wimpur in the prior 12 months.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability arising from intent, gross negligence, or mandatory consumer protection rules.
9. Changes
We may update these Terms. Material changes will be communicated by email or in-app notice. Continued use after changes take effect constitutes acceptance.
10. Governing law
These Terms are governed by the laws of the Netherlands, without prejudice to the mandatory consumer protection rules of the EU member state in which you have your habitual residence. Disputes will be submitted to the competent court of Amsterdam, the Netherlands, unless mandatory law designates another competent court.
10a. Dispute resolution (ODR)
If you are a consumer in the EU and we cannot resolve a complaint informally, you have the right to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Our contact email for ODR purposes is hello@wimpur.com. We are not currently obliged or willing to participate in alternative dispute resolution before a consumer arbitration board.
10b. Digital Services Act
For notices under Regulation (EU) 2022/2065 (Digital Services Act), including notices of illegal content, complaints about moderation decisions, and requests from authorities, please contact dsa@wimpur.com. We will acknowledge receipt and act on valid notices without undue delay. Communications with Wimpur and with authorities may be in English or Dutch.
